| Sumario: | Our Constitution dela Republic of Ecuador in its Article 11, paragraph 2, recognizes us and guarantees the right to equality of all citizens; ie a formal equal and have the same rights, obligations and opportunities. For its part, the State through the Ministry of Labour exercises political leadership in government policies on labor, employment and human talent in the public service, which regulates and monitors compliance with labor obligations by implementing effective, efficient processes, transparent and democratic models framed in comprehensive management system to achieve decent work, quality and solidarity to move towards social justice in equal opportunities. However, the Law on Public Service establishes the rights, obligations and penalties to which public officials are involved. When we speak specifically of the LOSEP sanctions in Art. 41 clearly states that should initiate the respective administrative proceedings incurred server in one of the offenses under the Act. Speaking of the administrative proceedings, these processes are under the responsibility of the Head of the Human Resource Unit of the institution, who is in charge of carrying out the procedure for summary and should penalize incurred on any grounds that law prohibiting it. Many times we have seen that these administrative proceedings, are not motivated or have been processed in violation of due process or in other cases the public administration through its authorities acted for reasons of affection or disaffection, which no doubt has led many servers lose their jobs without there being a just cause for it. This problem leads to the urgent need for the Ministry of Labour believes specialized units in order to know who they are and solve these administrative processes and thus find true impartiality, as they will be strangers to the institution who will to assess whether there are sufficient or not to sanction a public servant merits. |
