ANÁLISIS SOCIAL Y JURÍDICO DEL DELITO DE FEMINICIDIO COMO RESULTADO DE LA DISCRIMINACIÓN Y VIOLENCIA ENTRE HOMBRES Y MUJERES EN EL ECUADOR

This research work entitled Social and Legal Analysis of the Crime of femicide as a result of discrimination and violence between men and women in Ecuador , is a really important contribution to Ecuadorian society ; because it is based on a personal study of the Code of Criminal Integral where there has been changes from the incorporation of crimes including ; the femicide which refers to the person as a result of power relations expressed in any violence , death of a woman by virtue of being or their gender , shall be punished with imprisonment of twenty twenty-six years, and likewise establishing the circumstances under which he will be judged . Femicide according to Marcela Lagarde , stated that : It is a crime that only affects the lives of women worldwide ; It is that femicide shows the real context of violence and discrimination against women ; thus becomes one of the major social problems we face , it is evident that the social constructs of our society tolerate violence based on gender discrimination . Given this issue I want to stress that we are all human beings and have the same rights and opportunities, is why in this research work have made a social and legal analysis, in which it shows that not only in our country gives this type of murder but occur throughout the world and to eradicate such problems need 6 to radicalize the penalties and thereby make way for the transformation of justice for such crimes be punished. It is sad to know that Ecuadorian society; still it is going through the difficult path of domestic violence, where many women, whether these girls, young mothers, wives have been victims of abuse, some complained, but others have unfortunately been only records a dark and disturbing death their families and friends. In the Code of Integral Penal a definition of 22-26 years in prison is established, so in my opinion it is essential to increase the years regarding the crime of femicide, to more than not allowing the penalty is reduced no reason; since the murder of women must not go unpunished It is vital to emphasize that our Constitution guarantees that all people are equal and enjoy the same rights , duties and opportunities, and that no one shall be discriminated against on grounds of ethnicity, place of birth, age , sex , gender identity cultural identity , marital status , language, religion , etc. Thus highlighting that the law penalized all forms of discrimination in order to fulfill its legal system. That's why professional future, my goal is to motivate the Ecuadorian community for us to help eradicate discrimination and inequality in our society, 7 and this requires that foundations help promote equality and respect for the family, starting from the educational sector, where it educates children and young people in order that they be promoters of a happy life without abuse; and if there are acts of violence and discrimination at some point in your household , be made known to the authorities for them through their organizations enforce their rights especially living in a society free of violence. It is expressed the need for more study to recommend a legal proposal viably in the Code of Criminal Integral in order to protect the interests of citizens and thus contribute to its defense and social welfare.
