| Tóm tắt: | The present research work of curricular integration is entitled: "Exercise of Suffrage as rights and Guarantees in Ecuadorian legislation and in Comparative Law"; the purpose to develop this topic research is based on most recent events in Ecuador, where there is a noticeable political instability, leading to protests, marches and demonstrations, for and against the government in power, due to recent elections, dignitaries are elected to public office, without a prior analysis of the campaign, electoral process and especially the work plan presented by the candidates, however, on voting day citizens come to vote to complete the obligation but not by their own free decision. Therefore, marches, demonstrations or protests usually end in violence, with regrettable losses and even more without solving the problem in question, because there is no effective dialogue and political support from the majority of citizens. The present research work had as objective to develop a legal, doctrinal and comparative study of the right of participation and analysis of the voluntary vote, and to demonstrate that the voluntary vote allows the citizens to participate in a true democracy and to guarantee the State bodies, therefore, it is pointed out that the compulsory vote is where democracy is not exercised, because the citizens are required to vote in a compulsory way, and therefore the country becomes ungovernable. The methodology used was based on various methods, among which the statistical, scientific, analytical-synthetic methods are emphasized, which provided relevant results that when citizens are forced to vote and are subsequently penalized, they sometimes go to the polls unconsciously, or without having a candidate with whom they can identify themselves. Thus, democracy is not promoted, and much less an active or conscious citizen participation, which has generated a politically unstable country. |
