| Summary: | This research entitled NEED FOR REFORM THE ART. 67 CODE OF CIVIL PROCEDURE IN FOOD SPECIAL PROCESSES TO ENSURE THE BEST INTERESTS AND PRIORITY OF CHILDREN AND ADOLESCENTS. In this thesis, it is to ensure compliance with the rights of children, to the effect must implement electronic citation parents who are abroad. The electronic citation is a procedural action that is regulated by the Civil Procedure Code, which should be a reform of Article 67, in order to create legal powers for purposes of citation, preventing so that there gainsaying the legitimate and can exercise their right to self-defense, and therefore ensure priority and basic rights of children. In many cases, not able to set the address of the child's father, is obliged to pay solidarity food or acquit debts indexing issues, increase, increases in pensions, parenthood, prenatal support, among other rights guaranteed by our Constitution for the minor. Family rights have evolved to protect children, to ensure their moral and material development, therefore it is the duty of the state through policies ensure the fulfillment of the rights of children and adolescents. This thesis descriptive in nature, addresses a procedural problem latent in our society and should be remedied through legal mechanisms to be complied with the summons. |
