Análisis Jurídico, Doctrinario y Comparado sobre el Delito de Discriminación Laboral en el Código Orgánico Integral Penal

The Curricular Integration Work called: LEGAL, DOCTRINARY AND COMPARATIVE ANALYSIS OF THE CRIME OF LABOR DISCRIMINATION IN THE INTEGRAL ORGANIC CRIMINAL CODE, was developed with the purpose of knowing how labor discrimination affects the fundamental rights of workers and that this should be typified in the Integral Organic Criminal Code, also was developed as a prerequisite to opt for the title of Attorney, in accordance with the provisions of the Academic Regulations of the National University of Loja. The legal, doctrinal and comparative analysis on the crime of labor discrimination in the Organic Integral Penal Code, is important in our society, because it encompasses the entire labor environment and integrates the violation of constitutional and fundamental rights of workers, this work of curricular integration intends to focus on the violation of each of these rights guaranteed by the constitution and other regulations present in Ecuador, Within this legal, comparative and doctrinal study, we observe the causes of labor discrimination and its consequences, people constantly ignore this situation, workers avoid reporting these behaviors for fear of being fired or retaliation, which has been proven in the various testimonies observed in the interviews, the theoretical framework describes the different types of discrimination that occur within the work environment as: pregnancy, age, disability, gender, race, national origin, color, etc. discrimination; we will also study in depth the consequences that these actions produce, such as depression, which, thanks to the study of cases and news, we will observe the relevance of this issue and therefore, it should be typified within the Integral Organic Penal Code, as well as the economic necessity, derived from discrimination, affecting the labor income and the impact of this towards the members of the family nucleus, with the information collected, We will find that it is effective to typify these discriminatory actions within the Integral Organic Penal Code together with a prison sentence based on the analysis, jurisprudence and doctrine, since it is the legal goods that are violated, society and authorities should become aware of this problem and punish effectively, within the legal framework, this crime, helping to deter its practice and protect the rights of workers, these being fundamental objectives for a just and equitable society.
