Тойм: | The moral damage is a form of transgression of intangible rights that people have, when referring to intangible rights I refer primarily to moral, immaterial right when being violated needs to be repaired even though it is difficult to determine or patrimonial quantify the damage so accepted that repaired the damage with economic or money values. The only moral authority to quantify the damage are the judges so decides Article 2232 of the Ecuadorian Civil Code, which states "... being judge the wisdom of determining the value of compensation attentive circumstances ...", a fact that causes a vacuum legal and judges who confuse prudence with discretion or simply as moral freedom to quantify the damage. Which unfortunately implies that there is no limit to the quantification of moral damage. Although my way of analyzing the Act if there limitations that allow us to efficiently quantify the moral damage By the above, through this research process I allow me to propose parameters and rules for determining the amount to be compensated to the applicant by way of compensation for civil crimes of moral damages as well as the limits that exist to quantify the damage judicial moral way. |
