The labor code does not provide a clear and specific conceptualization about unfair dismissal, which is why most of the lawsuits filed by workers against their employers, are regarding this issue. Lack of laws and clarity in the matter, causes are regularly violated the fundamental rights of workers by their employers, leading to a large group of workers annually, remain dismissed from their jobs, which are forced to sue their former employers to compensate them, reaching settlement agreements to avoid labor disputes, which often does not justify the effort and the years of service on behalf of their employers. The aimwith thisresearchis to call for legal reform that contains a clear and precise concept of what is referred to summary dismissal, particularly causal point, where you should consider termination of a relationship labor as unfair dismissal, and thus to ensure the worker a better job stability and especially to be safeguarded in an appropriate manner the rights given to the working class

The aimwith thisresearchis to call for legal reform that contains a clear and precise concept of what is referred to summary dismissal, particularly causal point, where you should consider termination of a relationship labor as unfair dismissal, and thus to ensure the worker a better job stability and especially to be safeguarded in an appropriate manner the rights given to the working classEl presente trabajo investigativo, ha sido establecido para determinar que incidencia conlleva la institución del despido intempestivo en nuestra Legislación Laboral ecuatoriana, y de ese modo encontrar los mecanismos jurídicos más adecuados, que puedan ayudar a su mejor entendimiento y aplicación por parte de los administradores de justicia, a través de la aplicación de una definición precisa que aclare su verdadera naturaleza alcances, estableciendo causales puntuales, con la finalidad de que no se preste a interpretaciones ligeras y subjetivas de esta forma atípica de terminación de la relación laboral en el ámbito individual y colectivo del trabajo. El código del trabajo, no contempla una conceptualización clara y especifica acerca del despido intempestivo, motivo por el cual la mayor parte de las demandas presentadas por los trabajadores en contra de sus patronos, son referentes a este tema. La falta de disposiciones legales y claridad en el asunto, provoca que asiduamente sean violentados los derechos fundamentales los trabajadores por parte de sus empleadores, lo que conlleva a que un grupo considerable de trabajadores anualmente, sigan siendo despedidos de sus puestos de trabajos, los cuales se ven obligados a demandar para que sus ex empleadores les indemnicen, llegando a acuerdos extrajudiciales, para evitar el conflicto laboral, que muchas veces no justifica el esfuerzo realizado ni los años de servicios prestados a favor de sus patronos.
