Shrnutí:The development of this pre-qualification as a lawyer revolves around the problems associated with the social function of land in the context and alternatives research. This research aims to conduct a thorough legal, doctrinal and critical analysis about the right to land ownership. Through the development of theoretical and empirical content it has been achieved infer that currently the process of land use planning, understood as the set of democratic and participatory decentralized governments policies does not guarantee a real social function. Furthermore, the development of research I present the stipulations of the laws of other countries because of its proximity, are influential to our own rules, and some of which are circumstances that can be considered accurate to formulate the reform bill will be taken. Finally, this work is corroborated by conducting a field study regarding the problem to investigate, to what has been obtained the judgment of a group of professionals in the legal sciences through technical survey and interview who have expressed their views and opinions, suggesting the respective legal reform to the Organic Code of Territorial Organization, Autonomy and Decentralization is incorporated to land use planning grant genuine social function.
