This research topic is what made on the existing problems concerning the reality of people who retire from the private sector, which is a current problem in our social reality. For the development of this thesis I determined the general objective of Conduct theoretical, legal and critical study of the existing legal system with respect to retirement in the private sector, which was established through the application of methods and techniques of scientific, who guided me to achieve results that allowed that the proposal for reform of law. More than bibliographic doctrinaire collection, thirty were surveyed people who know and live the reality of this sector which is in the thesis, and three interviews lawyers in our city, with data that could collect it was concluded that people who retire at older they cannot fully enjoy their right to retirement, and do not have a life with great expectations, which is a problem for our society, and that the competent authorities should take appropriate action to address this sector as it is a source of accomplishment and is awarded by the efforts of its best years of life to work achieving a high socio-economic development of this country. Field research showed to be done to reform the Social Security Act, to ensure a dignified life in all areas, as required by the Constitution of the Republic of Ecuador.
