Análisis jurídico, comparado de la extensión de edad para el derecho de alimentos de los hijos adultos que cursan carrera universitaria

The present research is entitled “Legal analysis, compared to the extension of age for the right to support of adult sons who are studying for a university degree”, in the present work it is sought to demonstrate the need to extend the right to support to Adults sons who are studying a university degree, this means that this economic benefit of food continues to be provided to the adult child, while he is studying at the university to achieve the stated goal, which is the pursuit of his higher studies. The purpose of provision of food is that adult sons who are studying for a university degree can have what is necessary for their support, and also contribute through the completion of their academic training to achieve optimal integral development, which allows them to be positively inserted in society as professionals. In our Ecuadorian legislation, the right to support when the feeder has reached the age of majority and exceptionally at 21 years of age, if he is studying any educational level, 21 years of age is established as the limit to receive the provision of food, the age that university students have not completed their higher education, and therefore without the fundamental support provided by the right to food, they are forced to look for an activity that allows them to provide themselves with what is necessary and they will abandon their higher studies without professionalize. That is why, the study of comparative law, it seeks to establish budgets that help to establish a legal reform, which seeks to guarantee the right to food and the right to higher education for young university students in our country. In the present research, materials and methods were applied that allowed the development of the investigation, likewise, interviews and surveys were carried out with legal professionals, and young university students from the National University of Loja. The results obtained served to propose the legal reform to the Organic Code of Childhood and Adolescence to extend the right to food, until the children complete their higher education and thus guarantee the rights established in the Constitution of the Republic of Ecuador and international treaties to which our country is a part
