Итог:The present degree thesis is entitled: "Reform to the Comprehensive Organic Criminal Code classifying as a Crime the Usurpation of Uniforms and Insignia of the Armed Forces and National Police", and his interest in developing this issue is given, due to the realization of a study, in view of the fact that the Usurpation of Uniforms and Badges is a latent reality that manifests itself daily, generating violations of the fundamental rights of all people. The study carried out shows that the Usurpation of Uniforms and Badges, becomes a form of important criminal act, where the antisocial, through its misuse, generates violations of the different rights of people, all due to the low efficiency of control by the different institutions of the State, towards those commercial premises that are dedicated to the sale of Uniforms and other elements of the Armed Forces and National Police. In the presence of this, it is necessary to indicate that the aforementioned violation of rights must be effectively protected by the State, through policies and integrative actions to safeguard peace, security and integrity, towards possible crimes that may lead to commit. Which allows us to appreciate that at present this criminal act is being carried out in a simple way by antisocials, since there is no due control when we talk about the sale and use of Uniforms, Badges and other elements of the Armed Forces and National Police; It can be seen in turn that by misusing these uniforms, they can lead to the commission of other crimes, in a simple way, since in one way or another, they serve as tools for antisocials to do it, and 5 where the More affected would be the people, who as taxable persons are those who are violated the fundamental rights enshrined in the different legal regulations, this causes the state to fail to comply with what it mandates and typifies our Magna Carta, which is the protection of people, based on inclusive policies and actions, to promote peace and harmony for Ecuadorians. Faced with this conflict, it is necessary to indicate that the Usurpation of Uniforms and Insignia within our Ecuadorian legislation is not taken with the respective importance, leaving it as a simple contravention, but not as a crime, thus violating the already stated fundamental rights of However, in this thesis, materials and methods were applied that allowed the development of the research, likewise interviews and surveys were carried out with legal professionals, results that served to propose the project of legal reform to the Comprehensive Organic Penal Code, in order to classify as a Crime the Usurpation of Uniforms and Insignia, thus giving a solution to this problem, so that the fundamental rights of all people can be guaranteed.
