Шошго нэмэх | Тойм: | The present Curricular Integration Work entitled "Comparative legal study of persons deprived of liberty to avail themselves of permits in case of death of their relatives", arises with the need to carry out a doctrinal, legal and comparative analysis, with the aim of highlighting that as of 2016 the Regulation of the National System of Social Rehabilitation comes into force with the purpose of regulating and regulating the proper functioning and development of the National System of Social Rehabilitation, indicating that the aforementioned regulation is not guaranteeing the right of communication that persons deprived of liberty have with their relatives as established by the Constitution of the Republic of Ecuador. Possible solutions to the problem will be given through a comparative study of foreign laws such as those of Peru, El Salvador and Spain, with respect to the regulations of Ecuador, countries that typify a temporary exit permit for persons deprived of liberty in the event of death of their blood relatives in the straight ascending line, In contrast, in our legislation this family group is not included, so inmates sentenced for crimes punished with less serious penalties that do not exceed five years of imprisonment are not eligible for this benefit. For the support of the Curricular Integration Work, materials, methods, surveys and interviews with legal professionals were used, results that contributed to the proposal of an amendment to the Regulations of the National Social Rehabilitation System, incorporating an article aimed at guaranteeing the right to communication of persons deprived of liberty in case of death of their blood relatives in ascending and descending line and siblings. |
