Резюме:The present legal comparative law revolves around the formal development of the supra- constitutional, constitutional and infra-constitutional norm in relation to the principle of the best interests of children and adolescents and the phenomenon of child sexual violence that continues to affect this human group. vulnerable, which due to the fact of being so must be attended primarily by the State, society and the family. The Comparative Law study has been carried out based on the selection of some Latin American countries such as: Ecuador, Mexico, Colombia, Argentina, Uruguay, Chile, Peru and Cuba made in their common history consideration, which determines characteristic features in their political, social, cultural and legal development. This curricular integration work seeks to analyze the legal norm on child sexual violence through a comparative law study in Latin America determining its influence on the comprehensive protection of girls and boys, for through the of express legal provisions identification in relation to the type of State that governs the population, government and legal system; to the rights recognition and guarantees; the development of the comprehensive protection doctrine; the politicization of the norm for the prevention and eradication of gender violence, finally the development of the “ius puniendi” of the State by criminalizing criminally relevant behaviors, attacks on protected legal interests, such as the right to physical, psychological and sexual integrity; the right to a life free of violence and the c children and adolescents comprehensive development.
