Reformas a la ley orgánica de transporte terrestre tránsito y seguridad vial para el control y vigilancia de las niñas, niños y adolescentes en el transporte público y privado

During the preparation of this thesis has attempted to demonstrate the reality of the problem of public and private transportation of child and adolescent girls, which offer no security, directly affected the right to physical security and integrity of data including the right to life. The Constitution of the Republic of Ecuador, guarantees under the comprehensive development, in the best interests of them, thus to give effect to them, prevail over other rights. Likewise Stable trucking Organic Law Article 1, the purpose of it is "the organization, planning, development, regulation, and control modernization Terrestrial, Traffic and Road Safety Transportation, in order to protect people and goods move from place to place by the road network of the Ecuadorian territory, and the people and places subject to the contingencies of such displacement " With existing data sources could develop the Framework, where some concepts are determined and related to the problems presented within the doctrinal framework a study on the doctrine of irregular situation was made and the doctrine of integral protection are analyzed, then the study of the legal framework of this thesis, allowing develop a critical and legal analysis of the issues raised. Based on research methods could be applied to obtain results that allowed propose legal reform to the ORGANIC LAW LAND TRANSPORT SAFETY AND ROAD TRAFFIC, in order to establish control and monitoring of public and private transportation of children girls and adolescents who often travel on these carriers with strangers strangers that removed from their homes who, with the purpose of committing unlawful acts such as child prostitution, child pornography, white slavery or trafficking in organs, why this is necessary to average the right to life and personal and family integrity is protected. Through field research with the implementation of the survey and interviews with prominent lawyers who based their responses, and underlying objectives are fully verified, and the hiring of the hypothesis that it is positive, which has allowed me to reach conclusions and recommendations and proposed reform, where solutions to correct the loophole designated arise. With the development of this research aims to contribute somehow in control and monitoring units of public or private transport of adolescent boys and girls constituted a substantial contribution to this research.
