Garantía del bienestar de la fauna urbana en el código orgánico del ambiente, implementando medidas de protección que garanticen el cuidado, control, tenencia y manejo responsable de animales de compañía

The present legal investigation entitled "Guarantee of the Welfare of Urban Fauna in the Organic Code of the Environment, implementing Protection measures that Guarantee the care, control, possession and responsible management of pets", is developed in the context of the great violation of the rights that are deserved to animals belonging to the urban fauna, there being a great problem in the country regarding abuse, abandonment and in the worst case death of pets, in addition to a high rate of irresponsibility on the part of the citizens who own pets and competent authorities whose duty it is to enforce the regulations of the Organic Code of the Environment aimed at guaranteeing the principle of animal welfare of urban fauna. The present study carried out allows us to appreciate that there is a great violation of the regulations for the welfare of urban fauna, added to this the great ignorance on the part of the citizens and competent authorities of the regulations established in the Organic Code of the Environment, ignorance that does not exempts from any administrative responsibility but that nevertheless leads to there being too many cases of violation of rights such as the case of abandonment of pets that has in turn generated the overpopulation of stray animals, mostly dogs and cats. The lack of protection measures that guarantee compliance with animal welfare implies a great problem in the context of the violation of the rights of animals of the urban fauna and with them those of the company environment. The Constitution of the Republic of Ecuador guarantees the rights of nature, which involves everything that derives from it, in this case animals, therefore, mechanisms must be strengthened and implemented to guarantee the well-being of urban fauna and thereby the good harmonious coexistence of animals and society. It is in view of the aforementioned that a study has been carried out consisting of the application of a 5 methodology for the development of this legal investigation, in turn, surveys of law professionals and interviews with specialists in the subject were carried out, whose The results served as support to propose a project of legal reform to the Organic Code of the Environment, with the purpose of improving this regulation regarding the rights of animals of urban fauna, administrative sanctions and establishment of protection measures, to guarantee the responsible care, control, management and ownership of urban fauna, specifically pets.
