Tipificación del síndrome de alienación parental como forma de violencia psicológica en el código de la niñez y adolescencia

This research addresses the parental alienation syndrome, which is currently one of the legal problems of greater incidence in Ecuador, due in large part to the precarious durability of marriages, a situation that affects not only Ecuador but also Latin America in general. Parental alienation can be approached from the legal and psychological point of view, since such an attitude attacks against the upbringing of the child in a stable environment for the integral development of the minors, in addition to creating in the minor traumas that initially Are projected negatively against part of their family and later this attitude can be directed to the society, from the legal point of view can be evidenced the violation to the rights enshrined in the Constitution and the Code of the Childhood and Adolescence, the investigation had bibliographical support in the theoretical development, it was also field since the surveys were applied that allowed to determine the need to typify the syndrome of parental alienation as a form of psychological violence, the investigation allowed to conclude that the Code of the Childhood and Adolescence does not contemplate all The forms of psychological violations that may affect children and adolescents Olescentes, a situation that manifests itself in the legal vacuum of manifestations such as parental alienation, which is why a proposal for reform is proposed Article 67 of the Children and Adolescents Code with the objective of incorporating as a form of psychological abuse Parental alienation.
