Implementación de un nuevo tipo penal de violación a la intimidad e integridad sexual en el régimen penal ecuatoriano

This degree thesis takes by title: Implementation of a New Criminal type of Violation of privacy and sexual integrity, in the Ecuadorian Criminal regime, and how the non-existence of classification of the conduct of diffusion of images, videos, of sexual content, constitutes an affectation to effective protection, causing serious psychological and social damage in the victim´s environment. In this investigation and analysis of the project, it is demonstrated that the diffusion, publication, videos, images, where it is exposed abruptly and without the consent of the person their sexual intimacy through digital platforms, where many times this medium is in charge of a diffusion over the Internet, is a serious Violation of the constitutional rights that are established and protected by the Constitution of the Republic of Ecuador and International Instruments. On the other hand, it is evident how the Ecuadorian criminal law, that is, the Comprehensive Organic Criminal Code, does not full establish behaviors the violate the sexual integrity of a person by electronic means, since, as will be evidenced the creation of new technologies result in a huge gap, which facilitates the commission of computer crime, attack with innumerable legal rights, and without these behaviors being criminally sanctioned. In the present study various methods and materials were used that made possible evolution and development of the research, as well as conducting surveys and interviews with legal professionals extremely important result, with points of view ideas, totally different but base of law and with an enriching knowledge, which formed a fundamental part for clarification of various points and specify ideas that are part of the project Legal Reform to the Comprehensive Organic Criminal Code, with the purpose that the conduct of diffuse public images, videos of sexual content by electronics means is determined established, defined and sanctioned by law, so as to guaranteed the effective protection of the victims of this conduct and guaranteeing compliance of their rights that are intimidating.
