Riassunto:The Constitution is the supreme law of a sovereign state law sets limits and defines the relations between the branches of government, recognizing the Art.171. The authorities of the communities, peoples and nationalities will exercise jurisdictional functions, based on their ancestral traditions and their own right, within its territory. Speaking of Indigenous Justice or indigenous law , we refer to those practices from the customs of each commune, community , village and indigenous nationality , through which the authorities legitimately elected by its members regulate activities of social relationships and all kinds of conflict taking place within their community .The aim of this study is to determine the constitutionality of the forms of judgment in the indigenous law before the commission of an offense in the community of Canton Saraguro Ilincho province of Loja , our constitution states that our authorities implement rules and procedures for the settlement of internal conflicts which are not contrary to the constitution and human rights recognized in international instruments The State shall ensure that the decisions of the indigenous jurisdiction are respected by the institutions and public authorities. These decisions are subject to judicial review. The law will establish the mechanisms for coordination and cooperation between indigenous jurisdiction and ordinary jurisdiction. The State's duty is to enforce human rights under our own Constitution and international treaties, human rights are a set of universally accepted principles, recognized constitutionally and legally guaranteed
