সংক্ষিপ্ত: | The following research discusses the issue of the violation of the right to defense during advance testimony in crimes of sexual abuse of children, since the advance testimony serves as an integral element of the prosecution's arsenal of elements to investigate these crimes. In this diligence, the alleged victim will be able to testify about the facts under investigation and be interrogated about them for the first time. This mechanism implemented by the State to collect the testimony of the victim without subjecting him/her to direct contact with the alleged aggressor or suspect protects the integrity of the victim, but on the other hand it violates the right to defense of the suspect, particularly if the victim is a child, since in order to avoid revictimization, the technical defense of the investigated person is limited during the anticipated testimony, since the judge who directs the procedure does not qualify the questions posed by the defense, labeling them as inappropriate, suggestive, captious and unconstitutional. An important objective of the research was to determine if the limitations imposed during the anticipated testimony violated the suspect's right to defense. In addition to using field techniques such as surveys and interviews to collect data, a socio-legal research methodology with descriptive elements was proposed.
