| Samenvatting: | The state constitutional rights and social justice that is a feature of our Ecuadorian state under the terms of Article 1 of the Constitution of the Republic implies an exercise in thinking on the scope and recognition of constitutional rights against acts and behavior generated by public authorities, individuals, private companies providing public willing public and political services by public administration bodies. Important results from the above refer to the action of precautionary measures, because in addition to the judicial safeguards provided in the law of matter, the constitutional court is accessible to the protection of rights through this action; To do this let's review briefly what is stated in Article 26 of the Law on Jurisdictional Guarantees and Constitutional Control, it says: "Art. Finality.- 26. Precautionary measures aim to prevent or stop the threat or violation of the rights recognized in the Constitution and in international human rights instruments. Precautionary measures should be appropriate to the violation that is intended to prevent or stop such as instant communication with the authority or person that could prevent or stop the violation, the provisional suspension of the act, the order policing, the site visit of facts. In no case may order deprivation of liberty.
