Análisis integral sobre la gestación subrogada y su falta de legislación en Ecuador.

This thesis proposes the development of a comprehensive legal framework in the legislation of Ecuador for the regularization of surrogacy in heterosexual couples with conception difficulties due to infertility. This legal framework is given in order to guarantee the protection of the rights of the people involved in this procedure, because the lack of a regulatory regime gives rise to legal problems within the rights granted to the biological parents, the surrogate mother, and the child conceived through this process. Thus, this research work proposes a solution based on different principles, values and guidelines in order to enact rights and obligations for the control and supervision of any aspect of surrogacy, assisted reproduction techniques and any issue arising from them. We can determine, therefore, that since there is a percentage of infertility in Ecuador, surrogacy is seen as a solution to this problem of social character, without receiving the due diligence that such a serious issue involves, we can find gaps that can lead to legal problems. For the development of this study, different research materials and methods have been applied, among which we have: interviews and surveys conducted with legal professionals. The results obtained have been useful for the guidelines implemented in this work, due to the impartiality with which the answers have been given.
