LA FE PÚBLICA REGISTRAL MERCANTIL, COMO GARANTÍA DE LA IGUALDAD DE CONDICIONES ENTRE ACREEDORES Y DEUDORES FIRMANTES EN LA LETRA DE CAMBIO

The present thesis entitled: “The public mercantile registry faith, as a guarantee of equal conditions between creditors and debtors who sign the bill of exchange”, refers to the existing problem in the creation of the private commercial document called bill of exchange, where a part agrees to another to deliver a certain amount of money. And although the signing of said document is not alien to the will of the parties, what is verified is that after the contractual event this private document tends to be materially and ideologically altered to achieve different legal effects, when executing these titles in judicial processes. Likewise, to verify the aforementioned, materials, methods, interviews, and surveys were applied, which have helped me to propose a project of legal reform to the Commercial Code, where the commercial registry public faith is the reason for compliance of all the requirements at the time of the creation of the commercial document bill of exchange, this in order that that commercial document has greater probative value in a judicial process.
