Organic Law of the Public Service states that the Administrative Summary is the administrative, oral and reasoned process by which public administration or determine not the commission, administrative faults, by public servants. An administrative inquiry was carried out with the application of the guarantees of due process. However in the Organic Law of Public Service and its rules of procedure within the Administrative Summary violate constitutional guarantees as the appointing authority or his delegate is responsible for initiating administrative proceedings and then is responsible for sanctioning. When issuing the sanction the appointing authority preferably it will take a favorable state or will be on the side of the institution thus causing the violation of the principle of fairness and the right of everyone to be tried by impartial judges as decision determined by the Constitution of the Republic of Ecuador. The Comptroller General is responsible for the implementation of the control system, control and audit of State shall take place through: Internal control, which is administrative responsibility of each State institutions; and external control comprising: to. The coming under the Comptroller General; Y, b. The other institutions exercising state control in the sphere of its powers. Why there is a need that before the resolution of the appointing authority in the administrative proceedings; a control report issued by the General Comptroller of the State, so that there is fairness in administrative proceedings and resolution, thereby protecting the rights of public servants indicted was allocated. |

Constitucionalmente se manifiesta que toda autoridad sea administrativa o judicial debe garantizar los derechos de las partes, así mismo nuestra carta magna nos puntualiza que todos tenemos derechos a ser juzgados por jueces imparciales e independientes. En la Ley Orgánica del Servicio Público se puntualiza que el Sumario Administrativo es el proceso administrativo, oral y motivado por el cual la administración pública determinará o no el cometimiento, de las faltas administrativas, por parte de los servidores públicos. Un sumario administrativo se llevara a cabo con la aplicación de las garantías al debido proceso. Sin embargo en la Ley Orgánica del Servicio Público y su reglamento dentro del procedimiento del Sumario Administrativo se vulneran garantías constitucionales ya que la autoridad nominadora o su delegado es la encargada de iniciar un sumario administrativo y luego es el encargado de sancionar. Al momento de emitir la sanción la autoridad nominadora de preferencia va a tomar una decisión favorable al Estado o va a estar de lado de la institución provocando de esta manera la vulneración al principio de imparcialidad y al derecho de todos a ser juzgados por jueces imparciales como lo determina la Constitución de la República del Ecuador. La Contraloría General del Estado está encargada de la ejecución del sistema de control, fiscalización y auditoría del Estado se realizará por medio de: El control interno, que es de responsabilidad administrativa de cada una de las instituciones del Estado; y el control externo que comprende: a. El que compete a la Contraloría General del Estado; y, b. El que ejerzan otras instituciones de control del Estado en el ámbito de sus competencias.
