| 要約: | Migration presents two approaches; the emigration from the point of view of the place or country from where the population; and immigration from the point of view of the place or country where migrants arrive. In this sense, this research will focus on an analysis of national-legal instruments and processes on migration and issues in dispute due to the contrariety between the Constitutional theory and application of the Migration Act. In order to demonstrate the research, articles of the Constitution guaranteeing the fundamental rights of people who are in mobility Ecuador rewritten. Among the fundamental principles outlined in the Constitution of the Republic of Ecuador, recognizes the country as a constitutional state of law and justice in this sense it is the duty of the State, protection of the rights of the citizens, so that when applying constitutional rights, in practice, many and many of the citizens of other nationalities face difficulties when entering or decide to stay in Ecuador. This same study shows that citizens of European nationality entering the country mostly does to invest in Ecuador, and return to their country of origin after a certain time. In this regard I believe that the detention and deportation of citizens of other nationalities are arbitrary and illegal, why motivates me to make an investigation concerning the violation of Human Rights and inapplicability to the provisions of the Constitution of the Republic, State institutions involved in deportation proceedings and subsidiaries of this law. This situation forces me to propose legal reforms that contribute to this my larger goal |
