Gaia:The present research tries to implement the theory that treating the crime of killing a woman as a crime other than murder, is to say less exclusionary and discriminating for the male. We know and understand that in this society domestic violence is a latent problem that has not been eradicated, such violence is not a consequence of modern society, but on the contrary, it brings with it a very well hidden story, since it comes from a long time ago. In these days there is much talk about gender equity and we tend to demonize the issue that men and women are the same; However, when we talk about rights, we sometimes try to have women's rights prevail over those of men, and it is precisely there that when equity loses its objectivity, we can not speak of equity when we try to classify a crime only for a certain Population group (female population), since the laws must govern and protect all completely and from that perspective the crime of femicide has been improperly classified since not only women can be victims of domestic violence linked to the possibility of death. Nowadays it is more and more common to find out what product of domestic violence there are many men who are also physically and psychologically mistreated by their wives, and even in several cases have been killed by them, then this crime is not unique to men or women, this Crime has nothing to do with gender, rather it is a general offense, where the victim can be any man or woman, without distinction or condition; That is why it is inappropriate to have and sustain a criminal type such as femicide. Surely it can be embarrassing and even funny to hear that a man is being mistreated by a woman; However, it is a palpable reality in our society, where, although we recognize it, family violence is the bread of every day and victims can be any of its members, so justice must consider that the crime does not distinguish Gender and that the necessary actions must be taken to identify the inappropriateness of the criminal type of femicide.
