The present work of artificial investigation, approaches a topic of momentous importance inside the partner-juridical field which is the one of considering to the factors human and of the risk like circumstances to establish the driver's responsibility when traffic accidents are raised, factors that the current traffic legislation doesn't take them into account, when it is obvious to understand that they are momentous factors inside the accidentología vial. With the present artificial investigation I aspire to enlarge the field of the circumstances that you/they impact in the traffic accidents. An accident is an event or linkage of events, unexpected, unpremeditated and indeseados, generally of unpleasant consequences: injure to people and damages to the things. In traffic accidents, habitually the event is the temporospace coincidence of two objects or bodies. Inside the present investigation, the main matter is to determine to the human factor, fatigue, bad vision, dream, emotional problems and others that converge to that you of an accident; in a same way to consider to the factor risk, as explanatory causal circumstance of the traffic accidents, also that the Law of Traffic, inside its normative one considers to these factors like conditions of the traffic accidents
