Summary:This paper aims to establish what problems arise in judicial proceedings in defense of consumer rights and raise a proposal to have a clear process on protection of consumer rights are. We note that consumer rights have been recently established under Ecuadorian law, so you could say that there is little knowledge on the subject. It is necessary to establish how productive was the Organic Law on Consumer Protection and especially how effective was the procedure to judge violations of consumer rights. During the development of work seeks to answer the question of how effective is the current procedure for prosecuting violations of consumer ?, and answer this question, consider improvements to the process from checks results. Being newly implemented in our Ecuadorian law, I have seen the need for a deep doctrinal analysis of the basic concepts for proposing alternatives to a more effective exercise of the rights of consumers, particularly with regard to sanction procedure offenders and compensation for damages. I do not intend in this paper to perform a comprehensive analysis of all the implications of consumer rights, the issue concerning the exercise thereof, various forms of infringements, but focus on the judicial process of trial and also perform an analysis to the media alternative dispute resolution.
