Propuesta de reforma a la ley de minería, en relación a la elaboración de estudios de impacto ambiental, con el fin de evitar la contaminación del ambiente

Speaking of mining, we refer to a complex set of operations aimed to explore, extract and process mineral substances which are found in the soil and subsoil. This is the economic, commercial and industrial action based on exploitation and extraction of the mineral wealth that lies on the surface and subsurface, for which purpose there are mines and mining operations. This definition emphasizes which refers to the economic action that mining can give to a country and their respective effects of these. Such action means that in many cases is more emphasis on the economic benefit that produces, not on environmental impacts are causing. Effects that are caused by mining are highly visible in some places and are almost invisible in others. But, in addition to being a source of economic development, mining is also a source of much pollution that occurs in the environment in general. Out of the present, did not importance to the exploitation and the effects that mining would cause long term, but already a few years is has been taking momentum in awareness and making of new laws that force to carry a strict control over the mining production. Irrational use and the destruction of our natural resources are the example more clear zero environmental awareness surrounding the execution of projects of various kinds. This situation since the 1970's accelerated ecological consciousness and society began to understand that the source of environmental problems was in the economic and productive structures of the economy, this is mainly due to the production processes have been badly managed, therefore it is necessary to have more effective guidelines or systems allowing significant protection of the environment. For this reason it is essential that this activity is controlled and monitored to the maximum to somehow counter environmental degradation, since it generates major conflicts regarding the protection of the rights of nature in the chapter 7th of the Constitution of the Republic of the Ecuador. Article 14 of the Constitution recognizes the right of the people to live in a healthy and ecologically balanced environment guaranteeing sustainability and good live: declaring public interest in the preservation of the environment, the conservation of ecosystems, biodiversity and the integrity of the genetic patrimony of the country, the prevention of environmental damage and recovery of degraded natural areas. Facing this right is should highlight the importance of the study of the impact environmental how a requirement for get it license environmental for the development of it activity mining, that guarantees them rights of it nature and therefore should be considered and analyzed as the requirement essential for a concession mining, establishing is for this a procedure that facilitates its analysis and allow determine it fitness of its application real.
