| Summary: | In Ecuador, the legislator introduced in the Constitution in art. 3 as follows: "They are primary duties among others without any discrimination the effective enjoyment of the rights established in the Constitution and in international instruments." It is the inescapable duty of the State to guarantee all citizens of Ecuador equal rights and opportunities. However in the Code for Children and Adolescents need for greater protection, with regard to the requirements to be met by prospective adoptive parents of a child or adolescent; this lack of protection that that legislation has made social situations and foster care that do not guarantee effective protection for the child that is adopted to occur. Finally it should be noted that the National Assembly conducted and has been carrying out essential and fundamental changes to harmonize an environment that means living in areas of human dignity, these changes it began to give all people who live or pass through our Ecuadorian territory through the Constitution, a Constitution that guarantees rights; It is for that reason that the Code of Children and Adolescents, must be consistent with the supreme law concerning the rights of minors, which is why I propose to amend paragraph 7 of art. 159 of the Code of Children and Adolescents, on the rights of adoptees, where it is stated that the adoptive parents should enjoy adequate physical and mental health, not a drug addict or customary drunk, to thereby ensure the constitutional rights that have adopted. |
