Incongruencia normativa del código municipal de vía pública, circulación y transporte del Gad municipal de Loja, con las regulaciones establecidas en el Coip y reglamento a la ley de transporte terrestre, tránsito y seguridad vial, respecto a las sanciones por uso de la vía pública para fines de estacionamiento

The Constitution of the Republic of Ecuador, guarantees the principle of equality and proportionality in terms of infractions and sanctions, the rules established in the Municipal Code of Public Roads, Circulation and Transport of the Municipal GAD of Loja, compared to the Comprehensive Criminal Organic Code and the Land Transport, Traffic and Road Safety Law, generate the violation of this constitutional principle, thus causing the violation of the rights of citizens, before the imposition of an excessive pecuniary sanction, of 50% of a Basic Salary for parking a vehicle in an unauthorized location. In this sense, the present research work intends to demonstrate the existence of normative inconsistencies between the norms mentioned above, in terms of the sanctions established for the parking of vehicles in places not allowed, to show that there is a violation in a principle of equality and proportionality. and in this way prevent the rights of the citizens of the Loja canton from being violated by the imposition of excessive financial penalties for the misuse of public roads for parking purposes.
