Análisis de cumplimiento del acuerdo ministerial No. MDT-2023- 085, en las instituciones públicas del cantón Mejía

This Curricular Integration Work and legal research entitled “Analysis of Compliance with Ministerial Agreement No. MDT-2023-085, in the public institutions of the Mejía canton” arises from identifying a critical issue in the implementation of labor benefits for public servants in Ecuador. Public servants play a fundamental role in providing essential services to the State, benefiting the community without generating private profits beyond their salary (Porto, 2021). However, the lack of application of Ministerial Agreement No. MDT-2023-085, which establishes the provision of childcare services for the daily care of public servants’ children under five years old, has left these employees without the necessary support to reconcile their work and family responsibilities. The article 154 of the Constitution of the Republic of Ecuador establishes that the Ministers of State must exercise the leadership of public policies and issue administrative agreements (National Assembly, 2008). Despite this provision, the implementation of Ministerial Agreement No. MDT-2023-085 has faced significant obstacles. The insufficiency of financial resources, both at the governmental level and in public institutions, limits the capacity to establish and maintain adequate childcare services. This lack of investment and insufficient infrastructure prevent the agreement from being effectively implemented, directly affecting public servants who are entitled to these benefits according to Article 3 of the Public Service Organic Law (LOSEP, 2010). The lack of monitoring and control, as well as the lack of knowledge of the benefits on the part of public servants, exacerbate the problem.
