| Riassunto: | Ambulatory law is a constitutional guarantee that the been guarantees persons, in order to safeguard their fundamental rights, particularly their physical integrity, and the right not only is guaranteed in the Constitution of the Republic of Ecuador, but also instruments international Human rights. The right to freedom is stipulated in the Constitution of the Republic of Ecuador, as a civil right of every citizen of Ecuador will have it recognized, however in our country due to insecurity, are allowed an unlimited number of events coming to be the result of social decay, corruption, attack on civil rights, and failure of the basic guarantees of due process. As necessary structural reforms are in place, to ensure that this right is not violated. It is important that the state precautele the validity of this right by the punitive social control , since it is only empowered the state to implement the penal law, to maintain a social system , respect for the legal rights guaranteed erl State through the Constitution of the Republic of Ecuador . The anti-juridical actions against freedom and individual integrity, are sanctioned by the Penal Code with very light sentences. Establish legal reality that social failure of the guarantees of due process occurs, and propose an amendment to the Penal Code to improve the legal regime of crimes against freedom, and individual integrity. |
