Description
Résumé:The present research presented under the Thesis modality refers to a legal problem that deserves to be transformed to solve and overcome the socio- legal problem that is identified in the provisions of Art. 45, second paragraph of the Constitution of the Republic of the Ecuador, regarding girls, boys and adolescents who have the right to physical and psychic integrity; to your identity, name and citizenship; to integral health and nutrition; to education and culture, to sports and recreation; to social security; to have a family and to enjoy family and community life. In accordance with Art. 47, numeral 2 of integral rehabilitation and permanent assistance, which will include the corresponding technical assistance to persons with disabilities. However, the Organic Code for Children and Adolescents limits the follow-up time to two years after adoption, so it is insufficient because there is not adequate control, assistance and guidance of the post-adoptive phase of girls, children and adolescents with disabilities, in their condition of double vulnerability, subject to the control of the Technical Adoption Unit. Therefore, the Organic Code for Children and Adolescents must be amended, in Title VII, referring to articles 179 and 186, extending the post-adoption follow-up time until the a age of majority of girls, boys and adolescents with disabilities.
