Итог: | This thesis work entitled: "THE DISTRIBUTION AND MARKETING OF MEDICAL DRUGS AND INPUTS WITH OVERPRICE VIOLATE THE RIGHT TO HEALTH." It is the product of the study carried out of the current reality through which it has been going through the Ecuadorian Public Health System and which has caused serious consequences for all citizens. The present thesis includes a conceptual, legal and doctrinal study motivated given the needs to regulate specific distribution and commercialization of medicines and medical supplies that are overpriced, which violates the fundamental and constitutionally right that is recognized in health. With regard to what is established by the Organic Health Law in article 154.- "The State will guarantee access and availability of quality medicines and their rational use, prioritizing the interests of public health over economic and commercial ones". It is therefore imperative to carry out an analysis on the importance of this issue in health, in order to arrive at a reform proposal that allows to sanction all those anti-legal behaviors committed by both public servants at the time of purchase of these products, as well as suppliers for the sale of medicines and medical supplies at high prices. The purpose of this study is to demonstrate that the increase in haphazard prices of medicines and medical supplies that violates the fundamental rights such as the right to health and the right to personal integrity, which due to the lack of control and application of the law, these types of anti-juridical conduct remain in impunity. 5 Faced with this problem, the present thesis work was developed, which has been possible because it has had sufficient bibliographic material and criteria of authors who contributed to complete the revision of the literature, in turn, it has been essential to study the Constitution of the Republic of Ecuador, as well as the Organic Law on Health and the Regulations for the Fixing and Control of Prices of Medicines for Human Use and Consumption which are the regulations of application directly related to the subject. The analysis of this research can be verified through surveys and interviews conducted with legal professionals, which generate positive results to the proposal put forward that overpricing in the distribution and marketing of medicines and medical supplies violates the right to health. |
