Тойм:The autonomous heritage is the one in charge of promoting competitiveness and productivity in order to strengthen the sustainable value chain or in turn help to improve a tourism company, with the sole purpose that it can market a good or a service through the public-private strategic implementation of promotion and marketing, with which it allows it to face the challenges of the global market and take advantage of the business capacities and innovation of the axes for tourism business development. The present degree project entitled "Reform law to article 39 of the Tourism Law, due to the inapplicability of the rector ministry, with respect to autonomous heritage, generates an inefficient control and compliance in its administration", refers to the Tourism Law, in which is revealed to the Autonomous Heritage that is established in article 39 of the same legal body, where only the existence of a governing ministry and a tourism policy that promotes programs and plans to promote sustainable tourism development is mentioned, but that These policies are focused on economic development and increase of investments where they are determined and regulated through a ministerial agreement issued by the competent authority in which it provides general decisions where they repeal and amend previous ones to correct errors or legal voids and they put aside the tourist promotion. It is worth mentioning that the purpose of this project is to implement a standard where the autonomous heritage, which are the assets or resources that are administered through an administrative trust, is made up of the public entity such as the Ministry of Tourism, and organizations such as the Hotel Federation of Ecuador, the National Federation of Tourism Chambers, the National Association of Incoming Tourism Operators of Ecuador, among others, so that the tourism promotion fund becomes part of a trust since the money collected by part of the tourism sector goes directly to the fiscal box, which causes ineffective promotion and marketing in the country's tourism sector because a low budget is assigned. In the development of the thesis, the application of the doctrinal, legal, theoretical framework, application of surveys, interviews and case studies was carried out, which allowed obtaining precise and accurate criteria with logical reasoning that contributed to the verification of the general objective, specific objectives and finally to be able to contrast the hypothesis raised in the project concerning the reform of article 39 of the Tourism Law, due to the inapplicability of the rector ministry, with respect to autonomous heritage, generates an inefficient control and compliance in its administration, thereby violating legal certainty in the economic sphere due to not using resources optimally. Therefore, it is feasible to introduce a reform in the Tourism Law, in which it is proposed to establish in a better way that the autonomous heritage is a tourism promotion fund, in which it facilitates having a budgetary and dynamic flow so that through a strategic direction regulate the activities carried out by the heritage and the tourism sector is benefited.
