Opis
Streszczenie:The Curricular Integration Project titled Implementation of Life Imprisonment for Large-Scale Drug Trafficking as a Guarantee for Health, Life, and Personal Integrity demonstrates how large- scale drug trafficking severely affects the rights to health, life, and personal integrity. This occurs despite a comprehensive legal framework that classifies and penalizes this unlawful conduct, contrasting with the harm caused not only to the health of those consuming controlled substances but also extending its effects to society through crimes associated with this reprehensible illegal activity. These crimes include money laundering, fronting, illicit private enrichment, kidnapping, extortion, contract killing, murder, homicide, and sexual assault. Consequently, it is crucial to incorporate reforms into the Comprehensive Criminal Code, implementing revisable life imprisonment to control and reduce large-scale drug trafficking and thereby guarantee the enforcement of the rights to health, life, and personal integrity. To draw conclusions, recommendations, and a legal reform proposal, it was necessary to develop an extensive theoretical framework, establish a general objective, three specific objectives, and a hypothesis. Surveys and interviews were structured around these, targeting legal professionals, doctors, and psychologists, with several questions aimed at obtaining sufficient and solid foundations that allowed us to successfully achieve our goals. Three cases of large-scale drug trafficking were analyzed, where the maximum penalty provided by the criminal code was applied. In most cases examined, it was observed that the prosecutor legally classifies the punishable act as organization or financing for the production or illicit trafficking of controlled substances, which carries a higher penalty than the crime under study, confirming the need to review penalties for this offense.
