Description
Summary:This degree thesis is entitled "PRINCIPLE OF EQUAL RIGHTS AGAINST PARENTAL RESPONSIBILITY FOR THE TENURE AND SUPPORT OF CHILDREN, GIRLS AND ADOLESCENTS", the present investigative work is directed to the study of the lack of parental responsibility, not simply to the provision of food to which the parents are obliged, but to all the care and affection that minors require from their parents, this being an inescapable right that children and adolescents have. In this way, the investigation will be directed towards the proposal of a feasible solution that benefits children and adolescents, since children and adolescents are the fundamental element that the State has, in terms of the application of its fundamental principles, as well as priority attention, as it is the most vulnerable sector of society. In the development of the thesis, materials and methods were applied and interviews and surveys were carried out with legal professionals, the results of which served to propose a Project of Legal Reform to the Organic Code of Children and Adolescents, implementing the mandatory nature of support and shared food and implement the legal figure of shared ownership by the parents, that is, the person who has parental authority of the minor must in the same way justify and contribute monthly his contribution for the food, support and well-being of the minor, as long as he works and has the means sufficient funds, for this you must proceed in the same way as the parent or obligor does. In order to protect the principle of the best interests of the child and the principle of equality.
