Summary:The numeral 8 Article 326 of the Constitution of the Republic of Ecuador, on the right to organize states: "The State shall encourage the establishment of organizations of workers and employers and employers, according to the law, and promote their functioning democratic, participatory and transparent with alternation of leadership." This provision states as a basic rule, the alternation in the management of labor organizations in many cases throughout history in the public entity Ecuador have been in the hands of the same leaders, not giving way for their political, personal and privileged to management to other sectors, which makes it impossible to reach peaceful settlement of labor disputes and which have always served. On the other hand it is important the rotation indicated in the constitutional framework that leads to a better transparency in institutional management mechanisms certainly have sometimes damaged the interests of workers and have even led to the impairment of certain trade unions. I think that with this clarification as to the alternation, the State has the function of protecting and strengthening labor movements. But it is important to legislate within the governing Labour Code through an article, how it will perform that alternativity, legal fact to be contained in this Act, as if it is in violation of the Constitution in that it deals the guarantees of the right to freedom of organization of working people.
