Hencepart of thisresearch, therecognitionthatrights are violatedwiththis legal precept, forfurtherachieveharmonization of it, ie, achievepartialreform of article 34 of theMiningLaw, in order to avoidmisinterpretations, withrespect to time to meetthepayment of patentminingconservation.Este estudio investigativo tiene como finalidad el reconocimiento jurídico de que existe una antinomia normativa entre el artículo 34 y 108 de la Ley de Minería y la aplicación del artículo 34 ibídem por parte de la autoridad administrativa “Ministerio Sectorial”, vulnera el Derecho a la seguridad jurídica, el derecho al debido proceso, cayendo en una ceguera que, limite el derecho al trabajo y rescinda con las prestaciones de carácter patrimonial a favor del estado, cuyos tributos enriquecen el patrimonio nacional. El problema se genera en el plazo que tiene el concesionario minero para pagar las patentes, porque por un lado, el Art. 34 de la ley de Minería establece que el pago de la patente debe hacerse hasta el mes de marzo de cada año, que en ningún caso ni por vía administrativa o judicial se otorgará prórroga para el pago de esta patente, y por otro lado el Art. 108 de la Ley de Minería expresamente da una prórroga para el pago de la patente, al ordenar que el Ministerio Sectorial debe otorgar el término de 60 días al concesionario minero, para que subsane el incumplimiento de alguna obligación pendiente de cumplimiento (ejemplo: si no pagó las patentes a tiempo podría pagar en el término de 60 días que da la norma citada) y de esta manera librar se le extingan sus derecho mineros. En el desarrollo del trabajo se realiza el más minucioso estudio del precepto citado, así como de preceptos constitucionales y de legislaciones comparadas, so efecto de comprender su intención y de sus consecuencias. 3 De los resultados obtenidos se presentan posibles alternativas, con el objeto de que se tomen medidas más acordes a la actualidad jurídica que se encuentra atravesando nuestro país, ya que el paradigma constitucional instituido y aceptado por los ecuatorianos desde el 2008, es garantista de Derechos, y por ende favorable a las personas.
