Sumario:It is considered that the union between people of the same sex is a right based on the recognition that every human being can freely choose their marital status, decide when and with whom you want to live together and raise a family, because every human being is valuable in its own same, regardless of your tastes, gender, preferences or orientations, and their decisions. A reason for this is that every person should maintain an attitude of respect for others, so that in a democratic society everyone has to be considered equal, regardless of their sexual orientation, are entitled to all the rights the state recognizes and be able to develop without discrimination. The union also made a free decision of the individual, is a contract recognized by the state. Getting married is a right enshrined in the Universal Declaration of Human Rights and there is no reason to deny that right to people who are attracted to the same sex. It is not only the benefits that the union acts as the right to own property in common, to inherit the spouse or participate in social security, but this is the state to respect and recognize the free will of two people who want to share their lives and who wish to give legal certainty to their union. We are in a society that is defining our social roles, how to act and what to think. These social rules are intended to establish and delineate, right from wrong. Existing institutions are responsible for socializing these rules to keep them current, to perpetuate and to punish those who do not comply. This implies that, to be different in a world is a matter of vast complexity. Being different has a number of consequences. Any other person, thus belonging to a social minority is stigmatized, prejudiced, marginalized and discriminated against. When playing as the difference heartstrings as patterns of sexual identification, discrimination is usually higher. The dominant paradigm in this case heterosexism, produced by long speeches, termed as perverse or sick people who dare to be distinguished by their sexual behavior most. With respect to sexuality of individuals, psychiatry, religion and the law itself tend to define right and normal, abnormal and deviant, as specifically in the case of homosexual men and women. The need to provide recognition and protection of the rights of same-sex couples in civil unions, to prevent discrimination and ensure the protection the state and the constitution gives them as citizens, subject of this study, refers to that there should be excluded voices in the world. The Universal Declaration of Human Rights and international instruments adopted pursuant to it so that the world stopped having excluded voices: that among members of the human family there are no groups of men and women who can marginalize the full exercise of their rights and freedoms.
