CÓDIGO ORGÁNICO INTEGRAL PENAL ECUATORIANO, FIJA PLAZOS QUE RESTRINGEN EL EJERCICIO DE LA DEFENSA COMO PARTE DEL DEBIDO PROCESO

This research thesis entitled "The straightforward procedure established in the Code of Integral Criminal Ecuadorian fixed deadlines that restrict the exercise of the defense as part of due process," came the deep analysis to national criminal law, in concerning the application of the direct method stated in Art. 640 in item 4 of the Code of Criminal Integral, where do we mention: "Once qualified flagrante delicto, or the judge will mark the day and time for the hearing direct judgment within a maximum period of ten days, which will give its ruling ", demonstrating the violation of the rights set is the Constitution, specifically where the constitution shows us the right to defense, providing the opportune time for the preparation of defense, which is why as supreme law must prevail over all other internal rules, under the faithful performance of what rules the Constitution and the rights guaranteed to citizens. The theoretical, legal and doctrinal gathering, the study of specific cases, conducting surveys and interviews yielded specific criteria, with clear and precise basis of well known literature, which contributed to the verification of the objectives and testing of the raised hypotheses concerning this practice; both the Constitution and criminal laws criminalizing other rights to defense and timely preparation for it.
