Summary: | The present work of thesis is entitled: "The Principles of Citizen Participation in the Occupation of the Chair Emptyed by the Decentralized Autonomous Governments and the Right of Direct Democracy" the same as the interest of its development arises due to the inapplicability of sanctions with respect to citizen participation in the use of the Empty Chair therefore there is a violation of the constitutional principles of citizen participation. The mechanism of citizen participation called the "empty chair" seeks to guarantee the right of participation that the ordinary citizen has to be part of the decisions taken by the authorities of the decentralized autonomous governments to seek the solution of the needs of general interest that the citizenship.When this non-compliance exists, it causes the inequality of the rights and opportunities of the Ecuadorians in the public life of the country, since the emanation of the supreme law is not being complied with. In the Organic Code Territorial Organization Autonomy Decentralization in its article 312 establishes a penalty for non-compliance with the provisions related to citizen participation. The inapplicability of this sanction prevents the fundamental right of participation that citizens have to remain a dead letter. 5 The investigation has shown that there is an absolute disinterest on the part of municipal authorities to prevent the participation of citizens, as there are obstacles that prevent use of this mechanism. And it is considerable that the council of citizen participation is given coercive power to sanction the faults that occur in the breach to use the empty chair. Since there must be clear rules in the country to comply with the objective of direct democracy, otherwise it would be intentional and the authorities of the decentralized autonomous governments would handle their free will with political preferences and discriminations, damaging the constitutional principle of citizen participation. |
