Análisis del Derecho internacional Humanitario dentro del reconocimiento de Conflicto Armado Interno declarado por el presidente del Ecuador en enero de 2024

International humanitarian law is a set of rules that allows the study of internal armed conflicts within the branch of law and its correct application. This law is of utmost relevance in this degree work, since it is focused on international treaties and their application in different global contexts. This branch of law is in constant evolving in accordance with the changes in the world and the international conflicts that arise. Therefore, it is not rigid, but it can continue to develop in response to the situations that countries must face, especially globalization. This research work seeks to analyze the recognition of the Internal Armed Conflict declared by the President of Ecuador in January 2024, in accordance with International Humanitarian Law (IHL) and its correct application. The objective of this research study is to evaluate its implementation, compatibility with national norms and mechanisms to strengthen its respect and compliance. It has become evident that this law has not been correctly applied in the treatment of detainees following the declaration of the Internal Armed Conflict. Therefore, it is of great importance that the Ministry of Defense, the Judiciary Council and the National Assembly work together to act in accordance with International Law and ensure that the situation is under control and a possible peace situation can be reached.
