Zusammenfassung:The eighth grounds of Article 110 of the Ecuadorian Civil Code, violates constitutional principles, and that the Constitution in its articles states that all persons are equal before the law. That is why my research to get my law degree will focus on conceptualizing, framing, describe and analyze the problem described, in various contexts, prior to objectively assess the resources they have to make front, and offer alternatives to try to correct the deficiencies promptly. Furthermore, this research work can serve as a benchmark law and contribute to seek the protection of the rights of spouses upon divorce for the eighth causal, andto remember the Pyramid Kelsiana, wherein said author notes that the Constitution It is on the cusp of other laws, and for this reason we must respect the constitutional supremacy
