Afegir etiqueta | Sumari: | The present research work entitled "Lawfare and its violation of civil and political rights as a consequence of acts of political persecution", was developed due to the existing violation of the rights of political participation in relation to members of governments with opposing opposition, either in terms of non-observance of qualification of candidacies, inabilities to be candidates, thus attributing inefficiency and lack of transparency on the part of the organs of the Electoral Function. Therefore, it is a political-social problem that exists in our country and this has been ignored, thus attributing to go against the government that is positioned. Based on the study conducted, it was evidenced that in our country, a high degree of political characters have suffered violation of their rights of political participation, which is not fully complied with the provisions of the Constitution of the Republic of Ecuador, based on what it guarantees with respect to the rights of political participation. In addition, there is evidence of an abuse by the judiciary in terms of the disqualifications that suspend the enjoyment of political rights. In the present curricular research work, an investigation of topics related to Lawfare, Constitutional State of rights and justice, human rights was carried out. Likewise, a type of scientific, inductive, deductive, analytical, exegetical, comparative, statistical and synthetic methodology was used. In the same way, techniques were used that allowed obtaining criteria from professionals, such as surveys and interviews, in this way the problem was verified and reinforced to establish a possible solution to the social problem in electoral matters. |
