Sumari:The Article 26 of the Constitution of the Republic of Ecuador states that education is a right of people throughout his life and inescapable and inexcusable duty of the State. Is a priority area of public policy and government investment, ensuring equality and social inclusion and essential for good living condition. Individuals, families and society have the right and responsibility to participate in the educational process. Article 131 of the Law of Intercultural Education, says sanctions for legal representatives, principals, teachers, mothers and fathers of educational institutions must not commit offenses of harassment, abuse, sexual violence or other sexual offenses; and breach of the obligation to report to the appropriate judicial authorities cases of harassment, abuse, sexual violence or other sexual crimes committed by school officials against students. The unjustified omission of this requirement will result in dismissal. The Organic Law of Intercultural Education and Regulation establishes sanctions that students are imposed when they make minor, serious and very serious offenses, but there are no regulations on the prevention and treatment to the victim of bullying, for these reasons it is essential to legislate in this Act guaranteeing the integrity of students. In the educational setting is very common cases of bullying by classmates or themselves from the same institution, for which the Law of Intercultural Education should proceed to prevent and treat these events that arise in the the Ecuador educational institutions, especially schools and colleges is to prevent the psychological, physical and moral abuse of children and adolescents, affecting school performance.
