LA DESPENALIZACIÓN DEL ABORTO PROVENIENTE DE UNA VIOLACIÓN SEXUAL EN LA MUJER QUE NO PADECE DE DISCAPACIDAD MENTAL

The theme selected for the completion of the research work entitled "Decriminalization of ABORTION FROM SEXUAL VIOLATION IN WOMEN WHO DO NOT SUFFER FROM MENTAL DISABILITY" answers to the current problems being experienced by Ecuador, which still exists the criminalization of abortion, to those who cause it even in the event of rape in women who suffer from mental disabilities. The criminalization of abortion in all cases even when it is from a sexual offense in women capable of discernment denotes graphic violence in their rights and discrimination. He shielded ultimately with this investigation, in order to be able to demonstrate the need for regulation in our legal system Criminal decriminalizing the practice of abortion for rape victims who do not have mental disabilities. Importantly, in this research, fundamental aspects such as an analysis of the abortion in some countries, with emphasis on our own to get an idea on the subject and have knowledge about the strengths and gaps on legislation to on the issue. Likewise, it has also been referred to the way it is regulated the crime of rape in our Comprehensive Organic Code of Criminal Procedure, and then present 5 arguments to prove justification by which every woman who sexually having been raped and product of this crime you have become pregnant, it has the full right to decide the preservation or not, the product of rape. Finally, we have proposed a legal reform, in relevant part of the Code of Criminal Integral Ecuador, with regard to abortion.
