Para abordar esta cuestión, se utilizó un enfoque cualitativo que involucró métodos inductivo-deductivo, analítico-sintético, dogmático y comparativo, junto con técnicas de revisión bibliográfica y fichaje. Teóricamente, se justificó la importancia de incorporar la violencia vicaria como una forma de proteger los derechos de las víctimas directas e indirectas de violencia y establecer una línea clara de responsabilidad legal. Además, se analizó la colisión entre las disposiciones legales existentes y la necesidad de abordar adecuadamente la violencia vicaria en el contexto legal ecuatoriano.
