Description
Summary:This thesis is entitled "Mandatory and immediate protection measures in crimes against personal integrity, as a guarantee of special protection and not revictimization", the need for its realization arises due to the analysis made in the Organic Integral Penal Code, which shows that the judge does not provide immediate protection measures does not depend on a vacuum of law, but by malpractice of the justice system, the discretion of the judge plays a very important role to ensure the safety of the victim in the criminal process, This continued stereotype of interpretation of the law must be reversed, giving it value and taking into account the equal conditions of the victim of the crime, much more in the type of categorized crimes, because putting the active subject of the crime in the hands of justice does not exempt the victim from being subject to the commission of new criminal offenses or to suffer physical, psychological and sexual damages, either in the course of the criminal process or in the near future. In the development of the thesis, materials and methods were applied, as well as interviews and surveys applied to law professionals, results that served to propose a reform project to the Organic Integral Penal Code, incorporating regulations, The results were used to propose a project to reform the Organic Integral Penal Code, incorporating regulations that guarantee the obligation to grant immediate and urgent protection measures to victims of crimes that threaten their personal integrity or that, due to the magnitude of their dangerousness, generate a state of vulnerability to the victim, in order to guarantee the constitutional right of the victim to special protection and not to be re-victimized.
