La necesidad de normar el uso de las tecnologías de la información y comunicación en los procesos notariales

This research project was developed based on the possible implementation and integration of a regulation, which contains the use of technological elements that allow us implementing document scanning and process automation in the Ecuadorian attorney institution. A set of rules that regulate and standardize the use of information technology and communication functions, powers and duties of notaries notaries and their aims. This important research data showing us that there is viability in the laws of Ecuador to engage "TICS" in the notarial function is obtained. The following laws will be analyzed: Constitution, Organic Law of Transparency and Access to Public Information, Notarial Law, Law on Electronic Signatures Trade Data Messages and Regulations Civil Code, Code of Civil Procedure, Code of Judicial Function, Law of the National System of Public Data Registry. Regarding the permissive and relevant articles of the above laws, contributing to the issue, a regulation is proposed. It requires an analysis of the Ecuadorian notarial institution as a whole; and in order to proceed to exhibit the innovative proposal . The proposed regulations include a specific regulation for the notary of Ecuador . In its content was regulated to notarial institution internally and the user , establishing operating parameters, processes and process skills . The Ecuadorian legal framework enables the implementation of information technology and communication, which is legally appropriate the proposed legislation to regulate the notarial processes using information technology and communication. It is a permissive technological advancement in Ecuador that substantially benefits society in general, as well as representing a significant development in the legal processes controlled by the state. Technology is part of development. It is essential to recognize the digital revolution that exists in the world today, and as this virtual world affects us directly in our lives. It is a parallel world called the "information society"; It is a technological world that has a number of advantages that are positive for human development, but the disadvantages are also present to be problems. The advantages are many; agility, quality, maintenance, cost, availability and disappearance of geographical boundaries. It is a significant benefit, but problems create disadvantages; There are virtual crimes such as fraud, forgery, intrusion and violation. By implementing the use of document scanning and process automation in an institution that has not had that nature being previously should regulate this process trying to solve and avoid all possible conflicts; one of the reasons it has the right to exist is to combat conflict. Entering the field of law is essential to establish that Internet law is directly related , being a parallel world where there are acts and facts that are of legal significance , it requires laws to control human behavior in order for the State to send , prohibits or permits
